Gallery Terms of Service

1. Copyright & Ownership

• All photographs displayed in this gallery are the copyrighted work of the photographer and are protected by U.S. Copyright Law.

• Copyright is not transferred with the purchase or download of digital files.

• The photographer retains all rights unless otherwise stated in writing.

2. Personal Use License

Clients and authorized viewers are granted a non-exclusive, non-transferable license for personal use only, including:

• Personal viewing

• Personal printing

• Personal social media sharing

The following uses are not permitted without written consent:

• Commercial use

• Advertising or promotional use

• Resale or redistribution

• Editing, altering, or applying heavy filters

• AI modification or AI training use

3. Social Media Sharing

Images may be shared on personal social media platforms under the following conditions:

• Images may not be altered beyond basic cropping

• Watermarks may not be removed

• No AI enhancements, filters, or face/body alterations

• Photographer credit is included when possible

4. Youth Sports & Minor Subjects

For galleries containing youth athletes or minors:

• Images are provided for personal family use only

• Sharing is limited to private or personal social media accounts

• Images may not be used for team marketing, sponsorships, or merchandise without permission

• Coaches, clubs, and organizations must obtain written consent for any promotional use

5. HOA / Community Event Galleries

For HOA, neighborhood, or community event galleries:

• Images are intended for personal enjoyment and community sharing

• HOA boards, management companies, or sponsors may not use images for marketing or promotional materials without written approval

• Images may not be sold, licensed, or distributed to third parties

6. Gallery Access & Security

• Gallery links and passwords are provided for authorized viewers only

• Sharing access with unauthorized individuals is prohibited

• The photographer reserves the right to revoke access if misuse occurs

7. Downloads & Image Quality

• Images are delivered as digital files and provided as-is

• The photographer is not responsible for:

  • Color variation across devices or screens

  • Print quality from third-party labs not recommended by the photographer

• Best results are achieved using professional print labs

8. Gallery Availability

• Galleries may expire or be removed after the stated access period

• It is the client’s responsibility to download and save images before expiration

• Re-uploads are not guaranteed after gallery expiration

9. No Refund Policy

• Due to the digital nature of photography products, all sales and downloads are final

• No refunds or exchanges will be issued once images have been delivered or downloaded

10. Unauthorized Use

Unauthorized use includes but is not limited to:

• Commercial or business use

• Editing or AI manipulation

• Selling or licensing images

• Removing watermarks

Unauthorized use may result in:

• Revocation of gallery access

• Retroactive licensing fees

• Legal action if necessary

• 12. Photo Removal Requests

  • If you would like a specific photo removed from this gallery, you may submit a request to the photographer.

  • Requests must include clear identification of the image(s) (such as file name, screenshot, or description).

  • Removal requests are honored at the photographer’s discretion, especially for public, community, or event galleries.

  • Removal requests do not apply to:

    • Images already purchased or downloaded

    • Images used for portfolio, marketing, or promotional purposes where a valid agreement or implied consent exists

  • Once an image is removed from a gallery, it may not be retrievable or re-uploaded.

11. Agreement

By accessing this gallery, downloading images, or purchasing products, you acknowledge that you have:

• Read these Terms of Service

• Understood the usage limitations

• Agreed to comply with all terms listed above
